Beep Messaging LLC ("Beep," "we," "us," or "our") provides an SMS/MMS and civic-engagement messaging platform and related services. This Privacy Policy explains how we collect, use, disclose, and protect personal information through our website, platform, customer communications, support, and related services (collectively, the "Services").

This Privacy Policy does not apply to personal information we process as a service provider or processor solely on behalf of our customers except as described below. Our customers are responsible for their own privacy notices and legal basis for contacting individuals through the Services.

If you do not agree with this Privacy Policy, do not use the Services.

1. Information we collect

We may collect the following categories of information:

Website visitors and prospects

  • identifiers such as name, email address, phone number, organization, job title, and IP address;
  • communications with us, including demo requests, emails, calls, and support inquiries;
  • device, browser, log, cookie, analytics, and usage information; and
  • marketing preferences.

Customers and authorized users

  • account information such as name, email address, phone number, organization, role, login credentials, workspace, and permissions;
  • billing and payment information processed by our payment providers;
  • platform configuration, 10DLC/brand/campaign registration information, sender information, and support records;
  • usage, audit, security, and log data;
  • API keys, integration metadata, workflow configuration, prompts/instructions, and AI-agent-related metadata where applicable; and
  • communications with Beep.

Recipient/contact information processed for customers

Customers may upload, import, generate, or otherwise make available information about voters, supporters, members, donors, volunteers, staff, prospects, contacts, or other recipients. This may include names, phone numbers, email addresses, addresses, district/geographic information, demographic or public-record information, tags, source information, message history, replies, opt-out status, and other information selected by the customer.

Text messaging and mobile information

We process mobile numbers, message content, opt-in/opt-out information, message metadata, delivery status, replies, and related compliance records to provide the Services.

Mobile information and text messaging originator opt-in data/consent will not be shared with third parties or affiliates for marketing or promotional purposes. This restriction does not prevent sharing with vendors, consultants, telecommunications providers, carriers, aggregators, and other service providers who need the information to perform services for us or our customers, or disclosures required by law, legal process, carrier rules, or compliance obligations.

2. How we use information

We may use information to:

  1. provide, operate, secure, support, and improve the Services;
  2. create and administer accounts;
  3. process transactions, billing, usage reporting, and payments;
  4. register, maintain, troubleshoot, and support messaging programs, numbers, brands, campaigns, and 10DLC/carrier compliance;
  5. send, receive, route, analyze, and report on messages and replies at customer direction;
  6. detect, prevent, investigate, and respond to fraud, abuse, security incidents, policy violations, unlawful activity, and unauthorized access;
  7. debug, monitor, test, and maintain product quality and reliability;
  8. provide customer support and respond to inquiries;
  9. communicate about service updates, security notices, administrative messages, and product changes;
  10. market Beep's services to prospects and customers, subject to applicable law and preferences;
  11. create aggregated, anonymized, or de-identified information;
  12. comply with law, carrier rules, legal process, and contractual obligations; and
  13. enforce our agreements and protect rights, safety, property, and operations.

3. How we disclose information

We may disclose information to:

  • service providers and subprocessors that support hosting, infrastructure, telecommunications, SMS/MMS delivery, 10DLC registration, analytics, observability, security, payment processing, customer support, email, AI/model services, and other operations;
  • telecommunications carriers, aggregators, The Campaign Registry, verification providers, and similar ecosystem participants as needed to provide messaging services and satisfy carrier/compliance requirements;
  • customers and their authorized users, according to account permissions and customer instructions;
  • professional advisers, auditors, insurers, banks, and legal counsel;
  • government agencies, courts, law enforcement, regulators, carriers, or other parties where required by law, legal process, compliance obligations, or to protect rights and safety;
  • parties involved in a merger, acquisition, financing, reorganization, bankruptcy, dissolution, or sale of assets; and
  • others with consent or as directed by the customer.

We do not sell personal information in the ordinary meaning of the word. We do not share mobile information or text messaging opt-in data with third parties/affiliates for marketing/promotional purposes.

4. Customer-controlled data

For information customers provide about recipients or contacts, Beep generally acts as a service provider/processor. Customers decide what data to upload, who to contact, what messages to send, what legal basis applies, how to respond to individual requests, and how long to retain data, subject to their agreements with Beep and applicable law.

If you receive messages from one of our customers and want to opt out, reply STOP or follow the opt-out instructions in the message. You may also contact the customer directly. Beep can help route or implement opt-out requests where technically feasible, but customers remain responsible for their own contact lists, legal obligations, and communications.

5. Cookies and analytics

We may use cookies, pixels, web beacons, SDKs, log files, and similar technologies to operate the website and Services, remember preferences, analyze usage, improve performance, secure accounts, and support marketing. You can control cookies through your browser settings. Some features may not work correctly if cookies are disabled.

6. Privacy choices and rights

Depending on where you live and how we process your information, you may have rights to request access, correction, deletion, portability, restriction, or objection, and to opt out of certain processing. We will respond as required by applicable law.

If your request concerns information controlled by one of our customers, we may direct you to that customer or process the request at the customer's direction.

California residents may have additional rights under the California Consumer Privacy Act/California Privacy Rights Act, including the right to know, access, delete, correct, and opt out of certain sales or sharing. Beep does not sell personal information in the ordinary meaning of the word and does not share mobile information or text messaging opt-in data with third parties/affiliates for marketing/promotional purposes.

7. Data retention

We retain information for as long as needed to provide the Services, maintain accounts, comply with legal, tax, accounting, audit, security, carrier, and contractual obligations, resolve disputes, enforce agreements, and support legitimate business needs. Retention periods vary by data type, customer settings, legal requirements, and operational needs.

Customers may request return or deletion of Customer Data according to their agreements with Beep. We may retain information where required or permitted by law, security needs, backup practices, dispute needs, or compliance obligations.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is perfectly secure. Customers are responsible for managing their users, roles, devices, credentials, API keys, workflows, and integrations.

9. International users

The Services are intended primarily for use in the United States. Information may be processed in the United States and other locations where we or our service providers operate. If you access the Services from outside the United States, you understand that your information may be processed in jurisdictions that may not provide the same level of data protection as your location.

10. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 through our website or platform. Customers must not use the Services to unlawfully contact children or process children's data.

11. Links and third-party services

Our website or Services may link to third-party websites, tools, or services. We are not responsible for third-party privacy practices. Review their privacy notices before using them.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted with a new "Last Updated" date. If changes are material, we may provide additional notice as required by law or contract.
